1. Agreement to Terms
By downloading, accessing, or using the Hilltops mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you and HILLTOPS APP PTY LTD ("Hilltops", "we", "our", "us").
2. Eligibility
2.1 Age Requirement
You must be at least 18 years old to use Hilltops
By creating an account, you confirm that:
- You are at least 18 years of age
- The date of birth you provide is accurate
- You have the legal capacity to enter into these Terms
2.2 Account Requirements
To use Hilltops, you must:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly update any information that changes
- Not create accounts for others or transfer your account
2.3 Prohibited Users
You may not use Hilltops if you:
- Have been previously banned from the App
- Are a convicted sex offender
- Are prohibited by law from using social networking services
- Intend to use the App for illegal purposes
3. Your Account
3.1 Account Creation
You create an account by verifying your phone number and providing required profile information. You are responsible for all activity under your account.
3.2 Account Security
You agree to:
- Keep your login credentials confidential
- Notify us immediately of any unauthorised access
- Not share your account with others
We are not liable for losses arising from unauthorised use of your account.
3.3 Account Termination
By You: You may delete your account at any time through Settings > Account > Delete Account.
By Us: We may suspend or terminate your account if you:
- Violate these Terms or our Community Guidelines
- Engage in fraudulent, harmful, or illegal activity
- Create risk or legal exposure for Hilltops
- Have been inactive for more than 24 months
We will provide notice where practicable, but may act immediately where necessary to protect users or the service.
4. Using Hilltops
4.1 Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.
4.2 Restrictions
You agree NOT to:
Harmful Conduct:
- Harass, bully, stalk, or intimidate other users
- Post threatening, abusive, or hateful content
- Engage in discrimination based on protected characteristics
- Impersonate any person or entity
- Deceive or defraud other users
Prohibited Content:
- Post sexually explicit or pornographic material
- Post violent, graphic, or disturbing content
- Post content that exploits or endangers minors
- Post spam, advertisements, or solicitations (see § 4.6)
- Post malware, viruses, or malicious code
Platform Abuse:
- Use bots, scrapers, or automated tools
- Circumvent security or access controls
- Reverse engineer or decompile the App
- Interfere with the App's operation
- Access data you are not authorised to access
Illegal Activity:
- Use Hilltops for any unlawful purpose
- Violate any applicable laws or regulations
- Infringe intellectual property rights
- Facilitate illegal transactions
4.3 Rooms and Events
When creating or joining Rooms:
- Hosts are responsible for their Room's conduct
- Hosts may set audience preferences (e.g., Women Only) for safety purposes
- Attendance is at your own risk
- Hilltops does not verify event details or attendees
- Hilltops is not responsible for real-world interactions
- Members may display a pre-approved chat badge (e.g., "new here", "solo") next to their name in event chats to signal social intent — badges are chosen from a preset list, not free text
Hilltops Guide Activities
Hilltops Guide Activities are curated social opportunities generated by AI and presented in the app to help you discover new activities and connect with others. These activities are marked with "A Hilltops Guide Activity" in their description.
Important: Hilltops Guide Activities are NOT pre-organized events.
- These are suggested activities and opportunities, not events with confirmed hosts or organizers
- The suggested date and time are flexible starting points - members are expected to coordinate amongst themselves
- Hilltops Guide Activities do not have a dedicated human host - they are collaborative opportunities
- By joining a Hilltops Guide Activity, you understand that YOU and other members are collectively responsible for making the activity happen
- Location, venue, and activity details are AI-generated suggestions and should be verified by members
- Photos displayed are sourced from Google Places and may not reflect current venue appearance
- Members should use the Room chat to coordinate actual meeting times, confirm venue details, and organize logistics
Your Responsibilities for Hilltops Guide Activities
When joining a Hilltops Guide Activity, you agree to:
- Verify venue details, opening hours, and accessibility before attending
- Coordinate with other members to finalize plans
- Not assume a formal host or organizer will be present
- Take initiative to help make the activity happen if you're interested
- Understand that attendance may vary and the activity may not proceed if insufficient members coordinate
- Report any safety concerns or inappropriate behavior through the app
Hilltops Guide Activity Disclaimers
Hilltops does NOT:
- Organize, host, or manage Hilltops Guide Activities
- Verify venue availability, capacity, or suitability
- Guarantee that suggested activities will occur
- Guarantee accuracy of AI-generated location details or descriptions
- Take responsibility for coordination failures or member no-shows
- Verify Google Places photos are current or accurate
- Provide refunds or compensation if activities don't proceed as expected
Hilltops Guide Activities are provided "as is" as a discovery tool. You participate entirely at your own risk and responsibility.
4.4 Public Room Display on Website
Rooms with public visibility settings may be displayed on the Hilltops website (hilltops.app) to help users discover groups and events. When you create a Room with public settings:
- Your Room title, description, category, city/region, and event date may be publicly visible on our website
- Your display name (first name or username) may be shown as the Room host
- Only Rooms set to "Public" visibility with "Everyone" location visibility are displayed on the website
- Precise location coordinates are never exposed - only city-level information is shown
- Rooms with audience restrictions (e.g., Women Only, age requirements) are not displayed on the public website
- Room descriptions are only shown if chat visibility is set to "Public Viewable"
- Member lists and personal photos are never displayed publicly on the website
By creating a Room with public visibility settings, you consent to this information being displayed on the Hilltops website for discovery purposes. You can change your Room's visibility settings at any time within the App.
4.5 Messaging
- Do not send unsolicited, harassing, or spam messages
- Message requests require acceptance before conversation
- Do not share others' private information without consent
- Do not use messages to advertise, market, or recruit (see § 4.6)
4.6 No Advertising or Self-Promotion
Hilltops is not an advertising platform. You may not use the App, Rooms, messages, profile bios, display names, or photos to:
- Promote a business, brand, product, service, social-media account, podcast, newsletter, fundraiser, or affiliate link
- Solicit sales, sign-ups, follows, donations, or recruitment (including MLM, coaching, religious proselytising, or political campaigning)
- Direct users off-platform for promotional purposes
- Operate a consumer account on behalf of a business, brand, or organisation
- Cross-post or repeat the same content across Rooms or conversations
Mentioning what you do or where you work in normal personal context is fine. Hosting a Room for a genuine activity you're attending is fine.
Venues, promoters, and creators looking to list events should use the partner channel at hilltops.app/partnerships . Not the consumer App.
Hilltops may remove offending content, restrict posting, or suspend or terminate accounts where it reasonably considers that this clause has been breached. Whether something is advertising is determined by intent, frequency, and effect.
4.7 Audience Insights and Aggregate Data
Venues, creators, and other hosts may have access to aggregate audience insights about the people who follow or participate in their channels, rooms, or events. These insights are designed to be informative without exposing any individual.
- Insights are aggregate only and de-duplicated across the host's surfaces, never individual-level
- Members are included in aggregate audience insights by default. Users who have turned off discoverability in Discovery Settings ("Appear in Who's Around") are excluded from these aggregate counts
- Breakdowns are suppressed when the underlying group is too small to meaningfully obscure individuals, and the same protections apply when filters or breakdowns are combined
- Numbers may be rounded, smoothed, or delayed to reduce the risk of inferring individual activity
- Hosts must not attempt to re-identify, single out, or combine insights with outside information to identify individuals, and may not redistribute or repurpose insights for advertising, profiling, or sale
We may adjust the thresholds, cadence, and presentation of insights from time to time to maintain these protections. You may opt out of being counted in audience insights at any time through your privacy settings.
4.8 Service Changes and Future Pricing
Hilltops is currently offered free of charge. However, we reserve the right to introduce premium features, subscription tiers, or other paid services at any time. This may include features that are currently available for free becoming part of a premium offering.
If we introduce paid features, we will provide reasonable notice through the App or via email. Your continued use of the free tier (if available) or decision to subscribe to premium features will be at your discretion.
4.9 Referral Rewards Program
From time to time we may run a Referral Rewards Program that lets you earn free months of Hilltops Premium for inviting friends who join Hilltops. This clause sets out how the program works and the terms you agree to when you participate.
4.9.1 Eligibility
- Both the person inviting (the "referrer") and the person joining via an invite (the "referred user") must be 18 years or older and hold an active Hilltops account in good standing under these Terms.
- A referral is only counted once the referred user has completed onboarding (including providing the profile information the App asks for at that time). Signing up without completing onboarding does not credit a referral.
- You cannot refer yourself, and you can only be credited once as a referred user across your lifetime on Hilltops, regardless of how many invite links you tap.
- Each Hilltops account has a persistent invite code that can be shared with an unlimited number of people while the program is active.
4.9.2 Rewards
- The current reward — how many friends you need to invite and how many free Premium months you get — is shown inside the App on the invite screen. We may change these numbers from time to time by updating that in-App display; changes are not retroactive to rewards you have already unlocked.
- Rewards add up — every time you invite the required number of friends, you earn another reward, as long as the program is still active and you have followed the rules in clause 4.9.4.
- Premium rewards are delivered as free access to Premium through our subscription partner, RevenueCat, and apply across every device signed in to your Hilltops account. Free access is active for the stated duration and then expires automatically unless you take out a separate paid Premium subscription.
- Rewards have no cash value, are non-transferable, cannot be exchanged for any other product or service, and cannot be combined with, exchanged for, or refunded against paid Premium subscriptions purchased through the App Store or Google Play.
4.9.3 How Referrals Are Tracked
- When someone joins Hilltops using your invite link or QR code and completes onboarding, the App records the connection between the two accounts, the invite channel used, and the completion timestamp. This is described in our Privacy Policy.
- Successful referrals automatically add the referrer and the referred user to each other's friends list on Hilltops.
- You will be notified in-App and by push notification (if enabled) when a friend joins via your invite and when you unlock a reward.
4.9.4 Prohibited Conduct and Anti-Abuse
The Referral Rewards Program is intended to help genuine friends discover Hilltops together. To protect the integrity of the program, you must not:
- Create or use fake, duplicate, automated, or throwaway accounts (whether your own or through a third party) to inflate referral counts;
- Purchase, sell, trade, or otherwise commercialise invite links, invite codes, or referral credits;
- Publicly post your invite code on incentive sites, coupon aggregators, giveaway groups, or any other channel whose primary purpose is exchanging invite codes for value, rather than sharing with people you personally know;
- Use bots, scripts, macros, click farms, install farms, or any automated means to generate signups or referrals;
- Misrepresent Hilltops or the program to the person you are inviting (for example, by claiming rewards or features that do not exist);
- Circumvent, disable, or interfere with any of the anti-abuse measures described in our Privacy Policy or built into the App.
Where we reasonably suspect that a referral, a reward, or a pattern of activity breaches this clause 4.9.4 or any other part of these Terms, we may (without prior notice, and in addition to any other remedies available to us):
- Withhold, void, or reverse any unpaid or unearned reward;
- Revoke any free Premium access previously granted through the program (including access delivered via RevenueCat);
- Exclude the affected accounts from the program on a temporary or permanent basis; and
- Suspend or terminate any account involved, in accordance with clause 3.3.
We will exercise these rights reasonably and proportionately to the conduct. Nothing in this clause 4.9.4 limits any rights or remedies we may have at law.
4.9.5 Changes and Discontinuation
The Referral Rewards Program is a promotional offer that we may modify, pause, or discontinue at any time, in whole or in part, by updating the in-App invite screen and — for material changes — providing reasonable notice through the App or by email. Rewards you have already unlocked before a change or discontinuation takes effect will not be revoked solely because the program has changed, subject to clause 4.9.4 (anti-abuse). No compensation is payable to you if we change or end the program, and participation in the program does not create any entitlement to continued eligibility or future rewards.
4.9.6 Third-Party Store Rules
Referral rewards are provided by Hilltops directly and are not subject to any refund, cancellation, or dispute-resolution process operated by Apple, Google, or any other app-store provider.
4.9.7 Australian Consumer Law
Nothing in this clause 4.9 excludes, restricts, or modifies any rights or remedies you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified. Where you are entitled to such rights and remedies, this clause 4.9 operates subject to them.
5. User Content
5.1 Your Content
"User Content" means any content you post, upload, or share on Hilltops, including profile information, photos, messages, and room details.
You retain ownership of your User Content. By posting, you grant Hilltops a worldwide, royalty-free, sublicensable licence to use, copy, modify, display, and distribute your User Content for the purpose of operating the App.
5.2 Content Standards
Your User Content must not:
- Violate these Terms or Community Guidelines
- Infringe any third party's rights
- Contain false or misleading information
- Be illegal, harmful, or offensive
5.3 Content Removal
We may remove User Content that violates these Terms, without notice. We are not obligated to store or maintain your content.
5.4 Content Responsibility
You are solely responsible for your User Content. We do not endorse or verify User Content and are not liable for any content posted by users.
5.5 Photos in Business Channels and Event Chats
Some conversations on Hilltops are operated by businesses — venues, promoters, and creators using the Hilltops Business Portal. When you post photos or videos in a business-operated channel or event chat:
- You still own your photos. The ownership terms in Section 5.1 apply. Posting inside a business chat does not transfer ownership to the business.
- The business can see and download what you post there. As the operator of that conversation, they can view, browse, and download the media you share in it — so they can moderate the community, respond to attendees, and organise photos across their events. Every image is shown alongside the name of the person who posted it.
- Businesses must ask you before reusing your photos publicly. A business must not repost your photos in public marketing — websites, social media, paid ads, or printed material — without your permission. Where you have given permission, they should credit you where practical.
- You can remove your photos at any time. Deleting the message that contains a photo removes it from the business's media view as well.
- If you see misuse, contact the business first. If a photo of yours has been reused publicly without your consent, reach out to the business directly to request removal. If that does not resolve it, email us at support@hilltops.app and we will do what we can to help, including where relevant contacting the third-party platform hosting the reuse.
5.6 Photo Scanning and Content Moderation
Every image you upload to Hilltops — profile photos, room and event photos, chat images, and Hillsnaps — is scanned by an automated content-moderation service before it becomes visible to other users. The scan checks for nudity, graphic violence, and weapons.
- Photos are scanned before they go live. During the scan (usually a few seconds) your photo is held in a private area that no other user can access.
- If a photo is flagged, we'll ask you to try another one. For safety reasons — and to stop the system being gamed — we don't tell you which specific rule was triggered.
- Flagged photos are held for 90 days. A flagged photo stays in a private quarantine area for up to 90 days so we can review it (and, if required, share it with safety regulators) before it is permanently deleted. It is never publicly visible during this time.
- Child safety takes priority. Content suspected of depicting child sexual abuse is retained and reported to the Australian eSafety Commissioner (or the equivalent regulator in your country) in line with the Online Safety Act 2021 (Cth). This applies even if you delete your account.
- You can contest a decision. If you believe a photo was flagged in error, email support@hilltops.app and we'll review it manually.

6. Intellectual Property
6.1 Our Property
The App, including its design, features, code, trademarks, and content (excluding User Content), is owned by Hilltops and protected by intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our written permission.
6.2 Feedback
If you provide feedback, suggestions, or ideas about Hilltops, you grant us the right to use them without compensation or attribution.
7. Third-Party Services
7.1 Event Data
Hilltops displays event information from third parties (e.g., Ticketmaster). We do not guarantee the accuracy of this information. Ticket purchases are made directly with third parties and subject to their terms.
7.2 Links
The App may contain links to third-party websites or services. We are not responsible for their content, privacy practices, or terms.
7.3 App Stores
Your use of the App is also subject to the terms of the app store you downloaded it from — either Apple's App Store Terms of Service (iOS) or the Google Play Terms of Service (Android).
8. Safety and Reporting
8.1 Your Safety
Hilltops is a platform to connect people. We cannot guarantee user behaviour. You are responsible for your own safety when interacting with others, especially at in-person events.
Safety Tips:
- Meet in public places for first meetings
- Tell someone where you're going
- Trust your instincts
- Do not share sensitive personal information
- Report suspicious behaviour
8.2 Reporting
You can report users or content that violates these Terms or Community Guidelines. We will review reports and take appropriate action.
You can also report serious matters to:
- Local police
- eSafety Commissioner (Australia): www.esafety.gov.au
8.3 Cooperation
You agree to cooperate with any investigation into violations of these Terms, including providing information when requested.
9. Disclaimers
9.1 "As Is" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not warrant that:
- The App will be uninterrupted, secure, or error-free
- The App will meet your requirements
- User Content is accurate or reliable
- Any defects will be corrected
9.2 User Interactions
WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, WHETHER ONLINE OR OFFLINE. You assume all risk when interacting with other users.
9.3 Events
WE DO NOT ORGANISE, HOST, OR VERIFY EVENTS OR ROOMS. We are a platform for users to connect. Attendance is at your own risk.
10. Limitation of Liability
10.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Hilltops SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or goodwill
- Personal injury or property damage arising from your use of the App
- Conduct of other users, whether online or offline
- Unauthorised access to your account or data
- Errors, omissions, or inaccuracies in the App
10.2 Liability Cap
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR AUD $100, WHICHEVER IS GREATER.
10.3 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies rights you may have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
11. Indemnification
You agree to indemnify and hold harmless Hilltops, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your User Content
- Your violation of these Terms
- Your violation of any third party's rights
- Your interaction with other users
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of New South Wales, Australia.
12.2 Informal Resolution
Before initiating formal proceedings, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.
12.3 Jurisdiction
Any disputes not resolved informally shall be resolved in the courts of New South Wales, Australia. You consent to the exclusive jurisdiction of these courts.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by:
- Posting updated Terms in the App
- Sending a notification (for significant changes)
Your continued use of Hilltops after changes constitutes acceptance. If you do not agree with changes, stop using the App and delete your account.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Hilltops
14.2 Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
14.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
14.4 Assignment
You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.
14.5 No Agency
Nothing in these Terms creates any agency, partnership, or joint venture between you and Hilltops
